I-9 compliance has been a serious issue for employers. Immigration and Customs Enforcement (ICE) have begun utilizing techniques previously reserved for drug enforcement investigations and have instituted criminal charges against employers and employees individually for hiring illegal workers. The Department of Labor has increased its audits so that companies that have never before been targeted, now find themselves subject to investigation and significant civil penalties.

To avoid these penalties, an annual internal audit is necessary to not only review the I-9's in possession of the employer, but to also review the I-9 procedures. This ensures both that the I-9's are properly completed and that the employer is not engaging in unintentional employment discrimination.
